These Terms of Service (the "Terms") govern your access to and use of the websites, applications and services provided by SandboxRX ("we", "us", "our") at sandbox.connectusrx.com (the "Service"). By creating an account, signing in or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is a technology platform that connects healthcare practices, providers, pharmacies and patients and supports tasks such as secure messaging, prescribing workflows, ordering and fulfillment, document sharing and payments. We provide the software. We are not a healthcare provider, we do not practice medicine or pharmacy, and nothing in the Service is medical advice, diagnosis or treatment. Clinical decisions are made solely by licensed providers and the patients they care for.
If you think you are having a medical emergency, call 911 (or your local emergency number) immediately. Do not use the Service for emergencies.
You agree not to: break the law or violate the rights of others; access records or accounts that are not yours or that you are not authorized to see; share your credentials; interfere with or probe the security of the Service; upload malicious code; scrape or copy the Service by automated means; use the Service to send unsolicited or deceptive messages; or use it to prescribe, order or dispense in a way that violates applicable law or professional standards.
Practices, providers and pharmacies using the Service are independently responsible for their own licensure, clinical judgment, record keeping, patient communications and compliance with the laws that apply to them, including federal and state prescribing, dispensing and privacy laws. Use of the Service does not create a provider-patient relationship with us.
By providing a mobile number and agreeing to receive messages, you consent to receive account and service text messages from us, such as sign-in verification links and codes, security alerts, appointment, order and prescription status updates and messages sent on behalf of your healthcare organization. Consent to receive text messages is not a condition of purchasing any product or service.
Our handling of your mobile number and message data is described in our Privacy Policy.
Fees for products and services purchased through the Service are shown at checkout or in your agreement with the organization you are buying from. Payments are processed by third-party payment processors. We do not store full payment card numbers on our systems; card data is handled by processors that maintain their own security and PCI DSS compliance. You authorize us and our processors to charge the payment method you provide. Refunds and returns are governed by the policy of the seller shown at checkout and by applicable law.
You keep ownership of the information and documents you submit. You give us a limited license to host, process, transmit and display that content as needed to operate the Service and, where you direct, to share it with the practices, providers and pharmacies involved in your care or your orders. You are responsible for having the right to submit it.
The Service, including its software, design, trademarks and content we create, belongs to us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable right to use the Service for its intended purpose while you comply with these Terms.
The Service may link to or work with third-party services (for example payment, messaging, pharmacy and laboratory partners). Those services have their own terms and policies, and we are not responsible for them.
You may stop using the Service at any time. We may suspend or end your access if you violate these Terms, if required by law, or to protect the security of the Service or of other people. Provisions that by their nature should survive termination will survive it.
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the Service will be uninterrupted, error-free or secure.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of this may not apply to you.
You agree to defend and indemnify us against claims, losses and expenses arising from your misuse of the Service or your violation of these Terms or of the law, to the extent permitted by law.
We may update these Terms from time to time. The effective date above shows the latest version. If a change is material we will give reasonable notice, and continuing to use the Service after the effective date means you accept the updated Terms.
These Terms are governed by the laws of the United States and the state in which SandboxRX is organized, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in that state, unless applicable law requires otherwise.
